Terms of Use for MX Tech AI

1. Introduction

These Terms of Use govern your access to and use of MX Tech AI, including the mobile app, related services, and any content or features made available through the app.

By creating an account, accessing, or using MX Tech AI, you agree to these Terms of Use.

If you do not agree to these Terms of Use, you must not use MX Tech AI.

3. Eligibility

You may use MX Tech AI only if you are legally permitted to do so under applicable law.

If you are under the age required to enter into a binding agreement in your country, you may use MX Tech AI only with the involvement or permission of a parent or legal guardian where required by applicable law.

4. Your account

To use MX Tech AI, you need to create an account.

You are responsible for:

• providing accurate account information

• keeping your login credentials secure

• all activity that occurs under your account

• notifying us if you believe your account has been accessed without authorization

You must not impersonate another person or create an account using false or misleading information.

5. Use of the app

MX Tech AI allows users to create an account, complete onboarding, upload motocross photos, receive AI-generated riding feedback, view analysis history, save tips, and access subscription-based features. 

After onboarding, access to the main features of MX Tech AI requires an active subscription or an active free trial where offered. 

You may use MX Tech AI only for lawful, personal, and legitimate purposes.

You must not:

• misuse the app

• attempt to gain unauthorized access to the app, servers, or databases

• interfere with the functioning or security of the app

• upload content you do not have the right to use

• use the app in a way that violates applicable law or the rights of others

• copy, scrape, reverse engineer, or exploit the app except where permitted by law

6. User content

You are responsible for the photos and other content you upload or submit through MX Tech AI.

You confirm that:

• you own the content you upload, or have the necessary rights to use it

• your content does not violate the rights of any third party

• your content does not violate applicable law

You retain ownership of your content.

You grant us a limited, non-exclusive, revocable license to use, host, store, process, reproduce, and display your content only to the extent necessary to operate MX Tech AI, provide analyses, show your content back to you, maintain the service, and enforce these Terms.

7. AI-generated feedback

MX Tech AI uses artificial intelligence to analyze uploaded motocross photos and generate riding feedback.

The feedback provided by MX Tech AI is intended for general informational and training-support purposes only.

AI-generated results may not always be accurate, complete, or appropriate for every rider, situation, or image.

MX Tech AI does not guarantee that any analysis, score, recommendation, or feedback is correct, complete, or suitable for your specific circumstances.

You remain fully responsible for how you interpret and use any feedback generated by the app.

8. No medical, safety, or professional advice

MX Tech AI does not provide medical advice, healthcare advice, physiotherapy advice, coaching guarantees, legal advice, or any certified professional advice.

The app is not a substitute for in-person coaching, qualified instruction, professional training, medical judgment, or safety supervision.

Any riding decisions, training decisions, or safety decisions remain entirely your responsibility.

MX Tech AI is intended as a training-support and informational tool only. Users must always apply their own judgment and ride in a safe and responsible manner. Users must not rely on the app as a real-time safety system, emergency warning system, or substitute for qualified coaching, instruction, supervision, or common sense. 

Riding motocross involves inherent risks, and users remain solely responsible for their riding decisions, equipment setup, physical condition, training choices, and overall safety. 

9. Subscriptions and paid features

MX Tech AI offers paid subscription-based access to its core features. 

After onboarding, users must have an active subscription or an active free trial, where available, in order to use the main features of the app. 

Subscriptions may be offered on a recurring basis, including monthly or yearly plans, and may include introductory or trial offers where available.

Subscription prices, billing intervals, trial periods, and offer details are shown in the app or in the applicable app store before purchase. 

Access to paid features depends on an active subscription or entitlement.

10. Billing, renewal, and cancellation

If you subscribe through Apple App Store, billing is handled by Apple. If subscriptions are offered through Google Play in the future, billing will be handled by Google.

Subscriptions may include a free trial period where offered. Unless cancelled before the end of the trial or current billing period in accordance with the rules of the relevant app store, the subscription may automatically renew as a paid subscription. 

You can manage or cancel subscriptions through your Apple App Store or Google Play account settings, as applicable.

We do not control the billing systems of Apple or Google and do not process full payment card details ourselves.

Refunds, where available, are generally handled under the policies of the platform through which you purchased the subscription.

11. Free trials and promotional offers

MX Tech AI may offer free trials, introductory pricing, launch offers, or other promotional offers for eligible users.

Eligibility, duration, pricing after the trial or promotional period, and other conditions are shown in the app or by the relevant app store at the time of the offer. 

Unless cancelled in time under the applicable platform rules, a paid subscription may begin or renew automatically after a trial or promotional period ends. 

12. App availability and changes

We may update, modify, suspend, restrict, or discontinue all or part of MX Tech AI at any time, with or without notice, to the extent permitted by law.

We do not guarantee that the app or any feature will always be available, uninterrupted, error-free, or compatible with every device, browser, platform, or operating system.

We may also change features, pricing, subscription offerings, analysis logic, or supported functionality over time.

13. Account suspension and termination

We may suspend or terminate your access to MX Tech AI if:

• you violate these Terms of Use

• your use of the app creates risk, harm, abuse, or legal exposure

• we are required to do so by law

• continued operation of your account is no longer reasonably possible

You may stop using the app at any time.

You may delete your account in the app, subject to our Privacy Policy and any legally required retention obligations.

14. Intellectual property

MX Tech AI, including its software, design, branding, logo, text, features, visual materials, analysis systems, and underlying technology, is owned by or licensed to the provider and is protected by intellectual property laws.

Except as expressly permitted in these Terms of Use, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, sell, license, or exploit any part of MX Tech AI.

15. Privacy

Your use of MX Tech AI is also subject to our Privacy Policy, which explains how personal data is collected, used, stored, and shared.

By using MX Tech AI, you acknowledge that personal data may be processed as described in the Privacy Policy.

16. Third-party services

MX Tech AI may rely on third-party services, including services such as Firebase, RevenueCat, Apple, Google, and OpenAI.

We are not responsible for the separate terms, policies, or practices of third-party providers.

Your use of certain features may also be subject to the terms and policies of those third parties.

17. Disclaimers

MX Tech AI is provided on an “as is” and “as available” basis to the fullest extent permitted by applicable law.

To the fullest extent permitted by law, we disclaim all warranties, representations, and guarantees, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not guarantee that:

• the app will always be available

• analyses will always be accurate or useful

• the app will be free from bugs, interruptions, or security issues

• any training or riding result will be achieved through use of the app

18. Limitation of liability

To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses arising out of or related to your use of, or inability to use, MX Tech AI.

To the fullest extent permitted by applicable law, our total liability arising out of or relating to MX Tech AI will not exceed the amount you paid to use the app in the twelve months preceding the event giving rise to the claim, or EUR 50 if you have not made any payment, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

19. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold harmless the provider of MX Tech AI from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

• your misuse of the app

• your violation of these Terms of Use

• your violation of applicable law

• your infringement of the rights of another person or entity

• content you upload or submit

20. Governing law

These Terms of Use are governed by the laws of Belgium, excluding its conflict of law rules, unless mandatory law in your country of residence requires otherwise.

If you are a consumer, you may also benefit from any mandatory protections granted by the laws of your country of residence.

21. Dispute resolution

If you have a concern or dispute relating to MX Tech AI, you should first contact us at mxtechai.support@gmail.com so that we can try to resolve the issue informally.

Nothing in these Terms of Use limits any rights you may have under mandatory consumer protection law.

22. Apple App Store additional terms

If you use MX Tech AI on an Apple device, you acknowledge that these Terms of Use are between you and the provider of MX Tech AI, and not with Apple, except where Apple’s applicable terms require otherwise.

Apple is not responsible for MX Tech AI or its content, maintenance, support, or claims relating to the app, except as required under applicable law or Apple’s own terms. 

Your right to use MX Tech AI on Apple devices is limited to a non-transferable license to use the app on Apple-branded products that you own or control, subject to applicable App Store usage rules. 

Where Apple’s standard licensed application terms apply, they will continue to apply in addition to these Terms of Use where relevant. 

23. Google Play additional terms

If you access MX Tech AI through Google Play in the future, your use may also be subject to Google Play terms, billing rules, and platform policies.

24. Changes to these Terms of Use

We may update these Terms of Use from time to time.

If we make material changes, we may provide notice through the app, the support page, or other appropriate means.

The updated version will be indicated by the “Last updated” date at the top of these Terms of Use.
